Trademark Renewal

A registered trademark lasts ten years and can be renewed for further ten-year periods indefinitely. Renewal is filed in Form TM-R. Miss the date and there's a six-month grace period with a surcharge; after that, the mark can be removed from the register, though it can still be restored within a year of expiry. Why renewal slips

Ten years is long enough for the person who filed the mark to move on, for addresses and emails to change, and for the Registry's reminder to go unread. A lapsed mark weakens the owner's position against infringers and can let someone else register a similar mark.

We keep a renewal calendar for every mark we file or take over, and file well inside the window.

Documents required

  • Registration certificate or registration number.
  • Current proprietor details — updated if the owner's name or address has changed.
  • Power of attorney (Form TM-48).
  • For restoration: reasons for the delay.

How we handle it

  1. Check the register

    Proprietor, address and status as currently recorded.

  2. Record changes first

    If ownership or address has changed, the change is recorded.

  3. File TM-R

    Within the renewal window, or the grace period with surcharge.

  4. Confirm renewal

    The renewal is recorded and published.

Practical notes from our engagements

  • Owner changed but not recorded. After a company restructuring or assignment, the register may still show the old owner. Record the change before renewing.
  • Renewal missed by months. Within six months, it's a surcharge; after that, restoration needs reasons and the Registrar's discretion.
